​1. Definitions

Matching Puppy

A puppy meeting the Buyer's specified gender and size category (toy, miniature, or standard) from the selected breeding pair or an alternate pairing if transferred under the terms of this Agreement. Color is influenced by genetics and cannot be guaranteed.
 

Transfer

Any Buyer-initiated change including declining an available Matching Puppy, changing gender preference, requesting a different breeding pair waitlist, or adding requirements necessitating a different litter.

Circumstances Beyond Breeder's Control

Includes: no puppies of specified gender born; puppies of that gender did not survive or have health issues preventing sale; miscarriage, resorption, or failed breeding; dam health issues preventing breeding; or other veterinary emergencies.

Waitlist Organization
Klaus Poodles maintains separate waitlists organized by planned breeding pair (dam and sire) and gender. Waitlist position within each pairing is determined by deposit date.

​

Waitlist Capacity

Klaus Poodles limits the number of reservations accepted for each pairing based on anticipated litter size and program planning. The number of available waitlist positions for any pairing is determined solely at the Breeder's discretion and may vary.

​

Placement on the waitlist does not guarantee the availability of a puppy from a specific pairing.

2. Wait List Management Fee

A non-refundable Wait List Management Fee of $200 is required to join the waitlist.

 

This fee is refundable only if:

• the Breeder cannot match the Buyer with a Matching Puppy within 12 months of payment

• the Breeder cancels all planned litters with no viable options within 12 months; or

• the Breeder ceases operations entirely

3. Notifications & Transfers​

 

Program Updates

Klaus Poodles provides periodic updates regarding planned litters, breeding progress, and puppy availability. While Buyers are welcome to reach out with questions, routine updates are typically shared through email and Upcoming Litters on the Klaus Poodles website rather than individual status inquiries.

 

Due to the nature of breeding timelines, extended periods without updates may occur.
 

Waitlist Position Transparency

Klaus Poodles maintains waitlist positions based on deposit date and program criteria outlined in this Agreement. Buyers will not lose their waitlist position except under the conditions described in this Agreement.

Notification​

The Buyer will be notified via email and backup text when Matching Puppies are available.

​

The 48-hour response window begins at the time the notification email is sent.

​

Buyers are responsible for monitoring the email address and phone number provided and ensuring that communications from Klaus Poodles are not filtered to spam.

​

Failure to respond within 48 hours (excluding weekends and federal holidays) will result in forfeiture of the Buyer's current waitlist position.

​

No response within 14 days will be considered withdrawal from the waitlist and the Management Fee will be forfeited. This response period applies when the Buyer's first preference cannot be accommodated for whatever circumstances (e.g., dam does not get pregnant), and the Breeder needs to confirm the Buyer's intent to move their deposit to a different litter.

Transfer Policy

The Buyer receives one (1) complimentary Transfer.

 

After the first Transfer:

• second Transfer costs $50

• third Transfer costs $100

• fourth Transfer results in removal from the waitlist and forfeiture of all fees

 

Retention fees must be paid within 72 hours or waitlist position will be released.

 

What Counts as a Transfer

Declining an available Matching Puppy for any reason (including color, markings, temperament, or size within the specified range) counts as a Transfer.

Changing gender preference at any point counts as a Transfer.
 

What Does NOT Count as a Transfer

Breeder-initiated changes, being placed on a future litter due to Circumstances Beyond Breeder's Control, and moving up the waitlist due to others dropping out do not count as Transfers.
 

Failed Breeding or Litter Loss

In the event of failed breeding, miscarriage, or total litter loss, the Buyer's position and Management Fee automatically transfer to the next available litter at no charge.

Backup Pairing Designation

Buyers may designate a secondary breeding pair as a backup preference.

​

Backup designations do not reserve or hold a pick position on the backup pairing.

​

If a Buyer is transferred to their backup pairing due to Circumstances Beyond Breeder's Control, the Buyer will be placed on that pairing's waitlist according to their original deposit date, relative to buyers already on that pairing's waitlist at the time of transfer.

​

Transfers are permitted only if space is available on the destination pairing's waitlist at the time of transfer.

​

If no space is available, the Buyer will be offered placement on the next available pairing matching their stated preferences, or may elect to receive a full refund of the Wait List Management Fee.

​

Pairing Commitment

Once a breeding has been confirmed and puppies have been born, Buyers on that pairing's waitlist are considered committed to that pairing unless a Transfer is requested before puppy availability notifications are sent.

​

Requests to move to a different pairing after puppies are born will be treated as a Transfer and are subject to the Transfer Policy outlined in this Agreement.

​

Removal from Waitlist

The Buyer will be removed from the waitlist for:

• failure to confirm within 48 hours

• declining two or more Matching Puppies

• completing four Transfers

• failure to pay retention fees within 72 hours

• breach of this Agreement

Puppy Selection

Selection occurs at pick-up (approximately 8 weeks post-whelp) in order of waitlist position and deposit date.

​

Klaus Poodles reserves the first and second picks of each litter for breeder evaluation and program development. Buyer pick order applies after these breeder selections.

 

4. Breeder's Rights

The Breeder retains the right to adjust breeding plans, cancel litters, or remove the Buyer from the waitlist with a refund under qualifying circumstances.

 

All projected timelines and due dates are estimates only.

 

Klaus Poodles reserves the right to adjust pairings, timelines, or breeding plans as needed to support the health of our dogs and puppies.

​

Puppy Availability

Klaus Poodles reserves the right to withhold a specific puppy from sale if health, temperament, or welfare concerns arise prior to placement.

​

In such cases, the Buyer will retain their pick position and will be offered the next available puppy matching their stated preferences.

​

Klaus Poodles also reserves the right to retain any puppy from a litter for breeder evaluation or program development.

​​

5. Payment

Upon accepting a puppy offer, the Buyer must pay a non-refundable Puppy Holding Fee of $300.

 

The total purchase price is $3,500 (including the $200 Management Fee).

 

The remaining balance of $3,000 is due on or before pick-up.

 

Processing Fees

Zelle and Venmo incur no additional fee. Credit card payments and PayPal (goods and services) incur a 3% processing fee added to the payment total. Example: $3,000 paid by credit card = $3,090.

6. Ownership & Visits

Klaus Poodles maintains a strict no-visitor policy for breeder and guardian homes to protect the health of our dogs and puppies.

 

All pre-pickup interactions are conducted virtually through video calls, photos, and updates. Details on what to expect are provided in the Welcome Packet.

 

7. Additional Terms

 

Waitlist Position Non-Transferability

Waitlist positions are non-transferable and may not be sold, assigned, or transferred to another individual without the Breeder's written approval.

​

The Buyer listed on this Agreement must be the individual purchasing and taking ownership of the puppy unless otherwise approved by Klaus Poodles in writing.

​

Klaus Poodles reserves the right to remove any Buyer attempting to transfer or sell their waitlist position without approval.

​

Waitlist Inactivity

Buyers are expected to maintain current contact information and remain responsive to reasonable breeder communications.

​

If a Buyer is unreachable or unresponsive for a period of 90 consecutive days, Klaus Poodles reserves the right to remove the Buyer from the waitlist after reasonable attempts to contact them via the email and phone number provided.

​

Removal due to inactivity will result in forfeiture of the Wait List Management Fee.

​

Good Faith

This agreement assumes genuine intent to purchase. The Breeder reserves the right to remove buyers engaging without genuine purchase intent, including declining two or more Matching Puppies or extending the process through repeated Transfers without clear intent to complete a purchase.

 

8. Dispute Resolution

This Agreement is governed by Texas law. Both parties agree to attempt good faith resolution before pursuing legal remedies. Any legal action must be filed in Montgomery County, Texas.

Buyer Acknowledgement

By signing this Agreement, the Buyer confirms that they have read and understood the terms of the Klaus Poodles Wait List Agreement, including policies regarding waitlist position, Transfers, puppy offers, response timelines, and breeder discretion regarding breeding plans.

The Buyer acknowledges that joining the waitlist represents a good faith intention to purchase a puppy from Klaus Poodles under the terms described in this Agreement.
