Klaus Poodles Wait List Agreement

The purpose of this Agreement is to outline the terms and conditions for the Buyer to join the waitlist for a Klaus Poodles puppy. Wait list positions are for puppies meeting specified characteristics (gender, size, color), not for specific parent pairings. The Breeder makes no guarantee regarding which breeding dogs will produce the litter. Requests for specific parent combinations may be noted but are not binding.

1. Wait List Management Fee

A non-refundable Wait List Management Fee ("Management Fee") of $200 is required to join the waitlist. This fee is non-refundable except under the following circumstances:
 

  • If the Breeder is unable to match the Buyer with a puppy meeting the specified preferences within 12 months of receiving the Management Fee, the Buyer may request a refund or choose to remain on the waitlist. This 12-month period refers to the anticipated birth of the matched puppy, not the go-home date, which will occur about 8 weeks later depending on the puppy's age and readiness.
     

  • The Breeder changes breeding plans or cancels all future planned litters, leaving no viable options for the Buyer to receive a puppy within a reasonable timeframe (12 months from the date the Management Fee is paid).
     

  • The Breeder ceases breeding operations entirely.
     

2. Notification and Reservation Process

The Buyer will be notified via email when the Breeder has a litter with one or more puppies matching the Buyer’s specified preferences. A backup text message will also be sent to the phone number provided on the application.
 

Once notified, the Buyer must confirm their reservation within 24 hours. If no response is received within that timeframe, the Buyer’s position on the waitlist may be forfeited, and the Breeder reserves the right to offer the puppy to the next eligible applicant.
 

If we do not hear back within 14 days, we will assume the Buyer has chosen to withdraw from the waitlist, and the Management Fee will be forfeited.

3. Litter Transfer and Jump Policy

The Buyer is permitted one (1) complimentary transfer at no additional charge. This includes:

  • Passing on a litter where a matching puppy is available

  • Changing gender preference after initial selection

  • Requesting transfer between different breeding pair waitlists


After the first transfer, the following fees apply:

  • Second transfer: $50 retention fee to maintain waitlist position

  • Third transfer: $100 retention fee to maintain waitlist position

  • Fourth transfer: The Buyer will be removed from the waitlist, and all fees paid to date will be forfeited


We understand plans can change, and we encourage Buyers to reach out if they're unsure about their preferences before initiating a transfer.
 

A "transfer" is defined as any buyer-initiated change including but not limited to:

  • Declining an available matching puppy to wait for a future litter

  • Changing gender preference at any point

  • Requesting to move between different breeding pair waitlists

  • Adding new requirements that necessitate a different litter (e.g., specific coat type or allergy profile)
     

Transfers necessitated solely by Breeder changes (cancelled litters, health issues, etc.) do not count toward the Buyer’s transfer limit and incur no fees. Each retention fee must be paid within 48 hours of the transfer request to maintain waitlist position. If the retention fee isn't received within 48 hours, the Buyer’s spot on the waitlist may be released, and the Management Fee will be forfeited. We're happy to work with Buyers who need a little flexibility—just let us know.


4. Gender Preference and Availability

At the time of reservation, the Buyer must specify their desired puppy gender and other preferences (size, color, etc.). Gender preferences become final upon litter notification. Changes after this point may affect your waitlist position and incur fees. Other preference modifications require Breeder approval and may result in transfer to a different litter waitlist with position determined by existing deposits for those specifications.
 

If there isn't an available puppy matching the Buyer's chosen gender in the current litter, the Buyer can transfer their reservation to the next available litter with their position placed behind those already on that waitlist.
 

Note: Changing gender preference at any time constitutes a transfer and is subject to the Litter Transfer and Jump Policy fees outlined in Section 3.


5. Puppy Selection Process

Puppy selection occurs at pick-up (approximately 8 weeks post-whelp) in order of waitlist position and deposit date.

If no puppy matching the Buyer's specified gender is available from the current litter due to circumstances beyond the Breeder's control (e.g., no puppies of that gender were born, puppies of that gender did not survive, or health issues prevented their sale), the Buyer may either: (a) transfer their deposit to a future litter at no charge (this does not count toward their transfer limit), or (b) receive a full refund of their Management Fee.
 

However, if puppies matching the Buyer's specified gender are available but the Buyer declines them for other preferences (color, size, markings, temperament, or other characteristics), this constitutes a transfer subject to the Litter Transfer and Jump Policy outlined in Section 3.

6. Clarification of Transfer Policy

The following actions do not constitute a "transfer" and incur no fees:

  • Breeder-initiated changes (cancelled litters, breeding pair changes, health issues)

  • Moving up the waitlist due to others dropping out

  • Accepting an offered puppy

  • Being placed on a future litter when no puppies of the specified gender were available

  • Administrative changes initiated by the Breeder


A "transfer" only occurs when the Buyer voluntarily chooses to decline an available matching puppy or requests changes to their preferences.

7. Breeder’s Rights

The Breeder reserves the first and second picks of each litter and retains the right to:

  • Adjust breeding plans or cancel litters as needed

  • Void the transaction and remove the Buyer from the waitlist, with a refund of the Management Fee under the qualifying circumstances outlined in Section 1


All projected breeding timelines and puppy due dates are estimates only and subject to change. The nature of breeding involves many variables, and Klaus Poodles reserves the right to adjust pairings, timelines, or breeding plans as needed to support the health and well-being of our dogs and puppies.

8. Puppy Holding Fee and Final Payment

Upon accepting a puppy offer, the Buyer must pay a non-refundable Puppy Holding Fee of $300 to secure the puppy. This fee will be applied toward the final purchase price of $3,500, which includes the $200 Wait List Management Fee.
 

The remaining balance of $3,000 is due on or before the puppy pick-up date.
 

Accepted payment methods include credit cards, PayPal, Venmo, and Zelle. (Please note that payments made via credit card, PayPal, or Apple Pay are subject to an additional 3% processing fee.)

 

9. Pick-up Policy

Puppies must be collected at 8 weeks of age as this timing is critical for proper development and socialization. Klaus Poodles typically does not hold puppies beyond 8 weeks. Late pick-ups incur a $20/day boarding fee. Maximum boarding period is 3 days, after which the puppy will be re-homed.

Buyers unable to accommodate the 8-week timeline are encouraged to wait for a future litter that better aligns with their schedule.
 

Failure to collect the puppy within the maximum boarding period results in forfeiture of all deposits paid (Management Fee and Puppy Holding Fee), and the Breeder is free to sell the puppy to another party.

10. Ownership & Visit Policy

Puppies are sold as pet-quality companions only and do not come with breeding rights.
 

A signed spay/neuter sales agreement is required within 7 days of reserving a puppy, which typically occurs 1–2 weeks after the puppy's birth.
 

Klaus Poodles operates under a Guardian Program model, where our breeding females live in approved Guardian homes as beloved family pets. We maintain a strict no-visitor policy for both our home and our Guardian families' homes to ensure the health, safety, and well-being of our breeding dogs and puppies. This includes prospective families, wait list members, and other visitors. We maintain this policy to prevent disease transmission, reduce stress on our animals, protect our Guardian families' privacy, and maintain optimal breeding conditions. All pre-pickup interactions will be conducted virtually through video calls, photos, and regular updates.

11. Removal from Wait List

The Buyer may be removed from the waitlist under the following conditions:

  • Failure to confirm a reservation within the specified timeframe.

  • Declining two offers for a puppy where matching puppies are available.

  • Breach of the terms outlined in this Agreement.

12. Additional Terms
 

Allergy Disclaimer: While poodles and poodle mixes are often described as low-shedding and may be better tolerated by individuals with sensitivities, no dog is truly hypoallergenic. Klaus Poodles cannot guarantee that any puppy will be allergy-safe. It is the Buyer’s responsibility to assess compatibility prior to committing to a puppy.
 

Reasonable Communication Limits: We value thoughtful communication and are happy to answer questions. To ensure fairness and focus on puppy care, we ask that Buyers respect the following boundaries:

  • Limit contact to email during business hours

  • Avoid excessive communication (more than 2 contacts per week without invitation, calls exceeding 30 minutes, or repeated questions about previously addressed topics)

  • Check the breeder’s website for updates before reaching out

Deposit Transferability: Deposits are non-transferable and must be used by the original Buyer listed on the Wait List Agreement. Exceptions may be considered at the sole discretion of the Breeder and must be requested in writing.
 

Wait List Position Clarification: Wait list position is determined by the date the signed agreement and Management Fee are received. Klaus Poodles reserves the right to adjust placement based on breeding needs, puppy availability, or other operational considerations.

 

Guardian Program Inquiry: Wait list membership does not guarantee consideration for guardian programs. Guardian inquiries from wait list members will be evaluated separately and do not affect puppy wait list position.

 

Good Faith Participation: This agreement assumes good faith participation with genuine intent to purchase a puppy. Breeder reserves the right to remove buyers who appear to be engaging without genuine purchase intent, including but not limited to: repeatedly declining suitable matches, creating unreasonable requirements, or extending the process unnecessarily.

14. Agreement Acknowledgment

By signing below, the Buyer agrees to all terms and conditions outlined in this Wait List Agreement. The Buyer understands that payment of the Management Fee constitutes acceptance of these terms.

***IMPORTANT: The $200 waitlist fee reserves your position in line and supports administrative costs. It does NOT include:

  • Visits to meet parent dogs or puppies before pickup

  • Daily updates or check-ins

  • Input on breeding decisions or timelines

  • Priority customer service or special access

Our Guardian Program means breeding dogs live in private homes. ALL families receive the same virtual updates (photos, videos) according to our schedule. By submitting payment, you agree to these terms.​
