This agreement ("Agreement"), dated below (the "Effective Date"), is between Klaus Poodles ("Breeder") and the above-named Buyer ("Buyer").
-
Reservation Fee: A non-refundable Wait List Management Fee ("Management Fee") of $200 is required to join the waitlist. This fee is non-refundable unless the Breeder decides not to proceed with selling a puppy, in which case it will be refunded to the Buyer.
-
Waitlist Placement: The Management Fee secures a "pick" place but does not guarantee a puppy or specific preferences. Pick places are assigned on a first-come, first-served basis and are not negotiable.
-
Puppy Reservation Process:
-
Buyers will be notified when the Breeder has a litter with one or more puppies that match the Buyer's preferences as specified in the Puppy Application and reservation form.
-
Reservations must be confirmed by the Buyer within 24 hours of notification. If there is no response within 14 days, the Breeder may remove the Buyer from the waitlist, forfeiting the Management Fee.
-
Buyers may pass on one litter and transfer the reservation fee to a future litter. Declining a second offer may result in removal from the waitlist and forfeiture of the Management Fee.
-
Breeder Rights: The Breeder reserves the first and second pick of every litter, may change breeding plans, and may cancel a planned litter. The Breeder also reserves the right to void the transaction and remove the Buyer from the waitlist, with a refund of the Management Fee.
-
Puppy Holding Fee: If the Buyer accepts a puppy offer, a non-refundable Puppy Holding Fee of $300 is required to secure the puppy, which will be applied toward the final purchase price. The remaining balance of $3,000 is due at puppy pick-up.
-
Spay/Neuter Agreement: Puppies are sold as pet/companions only, with no breeding rights. A spay/neuter agreement is required at the time of sale.
-
Selection Timing: Families choose in the order they are listed on the Waiting List, usually when puppies are ready to go home at 8 weeks old. If a family is not present or reachable by phone during their 30-minute selection window, they forfeit their placement.
-
Non-Disclosure: In the event of a dispute, the Buyer agrees not to publish or discuss it in any media or forum, including social media. This does not prevent either party from taking legal action or engaging in confidential mediation.
